قد يسأل البعض ما هو السبب الذي جعلني أخوض في بحور الاقتصاد والتمويل المالي في المجتمعات . اسبب باختصار هي ألصدفه التي قادتني للحوار مع أختي وبعض الأصدقاء الرائعين الذي أضافوا لي الكثير من ألمعارف منها هذا العلم فقد قادتني وأركبتني في مركبها بجمال حروفها وسعة صدرها ومخزون عقلها المستنير بما به من ودرر .
ما هو الأصل الذي يستند عليه المشرعون في الاقتصاد والتمويل المالي . لقد لاحظت حسب فهمي البسيط بأنهم يستندون على حديث الرسول صلى الله عليه وسلم في حادثة تلقيح النخل(0 إن كان شيئا من أمر دنياكم فشأنكم به وان كان من أمور دينكم فالي ))ومن هنا ننطلق بمفهومنا بان الدين الإسلامي يدعو الإنسان المسلم لاستخدام العقل للوصول إلى أفضل التطبيقات لهذا الشرع في الدنيا,ويعتبر شيخ الإسلام بن تيمية .رحمة الله علية .من أوسع ألأئمة توسع في المعاملات الاقتصادية وتمويل المالية أو السلعويه إن جاز لي التعبير بهذا الفظ . حيث قال (( إن الدين ما شرعه الله ،والحرام ما حرمه الله ,والأصل في هذا انه لا يحرم على الناس من المعاملات التي يحتاجون إليها إلا ما دل الكتاب والسنة عل تحريمه ، كما لا يشرع لهم من العبادات التي يتقربون بها إلى الله إلا مدل الكتاب والسنة على شرعه)) بما إن هذا الواقع الاقتصادي للمسلمين والمعطيات المالية والإنتاجية لا تشابه الواقع الشرقي والغربي .وهنا حدث لبس وغلط كبيرين استغله بعض المفكرين والمشرعين بي استيراد الأفكار والأنظمة والسياسات الخارجية بغض النظر عن توافقها مع الدين الإسلامي أو توافقه وهذا سبب مزيد من التخبط في تجارب الغير والي التبعيه المطلقة للقوى العالمية التي استوردت منها هذه الأفكار حيث انه كان يجب على أولائك من الأخذ منها بما يفيد ويتطابق مع التشريع اللاهي بصفته ضام لجميع الرسالات والقوانين البشرية منذ إن خلق الله البشرية .وعليه نقول بان المسلمون يلزمهم من يمتلكون القدرات على التصنيف للمشاكل ومعرفة سبل مواجهتها بالإضافة إلى تقدير نتائجها ومعالجة أثارها الناتجة من هذه المعاملات الاقتصادية وتموينية المالية .ويجب إن يكوون أولائك المتخصصون يستطيعون تصنيف كل المجالات العلمية والتطبيقية خاصة والإنسانية بكافة جوانبها . دون إن يتأثر بأحد أو يميلون لأحد . بل يتجولوا بفكر حر لا يوقف تقدمهم للوصول إلى الهدف المنشود من التمويل وطرقة وأهدافه . وهذا بلا شك إن الالتزام به يحمي التعاليم الإسلامية ويحافظ على شخصيتها من خلال مواكبتها للتطور الحضاري في العالم وتحجز مكانها بين الأمم في تميزها بتقديم ما يمكن من التنمية وتطور المجتمع .
ولندخل إلي الموضوع وبعمق بسيط يسمح لنا بالفهم . لماذا نريد الاستثمار والتمويل المالي الشرعي بحسب النظام الإسلامي ؟
- الجواب لأننا باختصار لا نريد التعامل (بربا)ا. وهذا جواب تقليدي في نظري ونظر الأغلبية من المتخصصين في الاقتصاد والمحاسبة التمويلية المالية.
والفاهمين بتفسير الشريعة . لأنه لم يعد يجدي ولا يفي بالغرض لأنه حد من رؤيتنا في هذا المجال وجعلنا ننظر للأشياء بصورة منقوصة . وهذا مثال سنأخذه للتوضيح . وهو عن اليابان . إن اليابان قد وصلت نسبة الفائدة التمويلية إلي نسبة الصفر , فهل يعني هذا أن اليابان أصبح يتبع المعايير الشرعية الإسلامية ,وانه أفضل الأسس في الاقتصاد وتمويل المالي بالطبع ؟ الجواب في حرفين هما (لا) .
إن تفاعلنا مع هذه المتغيرات في الاقتصاد الذي يعتمد على التمويل المالي يجب إن يكون ايجابي وجازما ,
وعليه تكون إجابتنا عن السؤال السابق ؟
هي : إن الاستثمار الإسلامي المالي بموجب الأحكام الشرعية مطلوب لأسباب تعدد قنوات الاستثمار الاقتصادي ومنافعه التي تصل للفرد والمجتمع كافة , وليس لكونه نقيض( لربا) .هذا الجواب يكون أدق واشمل لماذا لا ن متطلباتنا وأهدافنا التنموية هي التي تحدد مطلبنا من النظام المنشود.
وهذا يقودنا إلي التنبيه وتوضيح إن الأنظمة الإسلامية عندا الاعتماد عليها وإقرار قواعدها يجب إن يدعمها النص الشرعي , لخدمة الأمة الإسلامية وتحقيق مصالحها .آخذه بالاعتبار مقاصد الشريعة وروح الإسلام عند التطبيق ,ويكون المنطلق والفعل نابعين من تحقيق مصلحه خاصة وعامة للمجتمع .وليسا ردة فعل على الأنظمة (الربويه) .ومن هنا وأخاطب دارسين أو طلاب علم الاقتصاد بجميع فروعه .وجنسيهما الأنثوي وذكوري انتم من يقع على عاتقكم المحافظة على هذه المبادئ الإسلامية. بتوضيح, والعمل بالممارسة أو تقديم الاستشارات . يجب علينا إن نعيد انطلاق حضارتنا على الأسس التي سبقنا إليها أسلافنا حتى وصلوا بالأمة إلى قمة العلم والحضارة ,
وهذه الأسس هي الاعتماد على النص الشرعي مع العقل ,و التجربة المستمدة من.التقيد بالعمل بشريعة الإسلامية,مع وجوب حسن الاستماع والإتباع والاقتداء بالسنة الشريفة , وعمل لصحابة رسول الله صلى الله علية وسلم, ومع التطوير ضمن المعاير والضوابط الشرعية , لقد سمعنا مقولة إن الإسلام صالح لتطبيق في كل زمان ومكان .وواجهة هذه المقولة الكثير من المعارضين المسلمين .ماذا نقول لهم نقول لهم لا فقد أخطأتم بل انه صالح في كل زمان ومكان ولنتعامل به على جميع الظروف ومؤثراتها أو مسببات وجودها .وهذا واضح في الكتاب وسنه .ودعوني هنا انقل لكم قول الغزالي (( فالداعي إلى محض تقليد مع عزل العقل بالكلية جاهل , والمكتفي بمجرد العقل عن أنوار القران وألسنه مغرور )) وهذا أمر صريح وواضح لان الإسلام نظم حركة البشر ضمن حرية تكفل الإسلام بحمايتها ضمن حدود وضوابط معينه .فكيف لا يكون الإسلام صالح لتطبيق في كل مكان وزمان وهو شرع منزل من خالق الكون بأكمله, ويضم جميع الرسالات السماوية السابقة وهو خاتمتها .إلي قدوم يوم القيامة
